Terms Of Service (TOS)

SeanHQ's servers provide web hosting and dedicated web hosting to many clients and has a responsibility to protect each client and to provide the best services available. The following guidelines were designed to ensure that these obligations are met.

All customers and users of SeanHQ services and/ or online facilities must comply with these Policies and Terms of Service at all times. Failure to comply with these Policies and Terms of Use may result in suspension or termination of services or other actions by SeanHQ.com.

Content:

All services provided by SeanHQ may be used for lawful purposes only. Transmission, storage or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to, copyrighted material, material we judge to be threatening or obscene or material protected by trade secret or other statute. The subscriber agrees to indemnify and hold harmless SeanHQ from any claims resulting from the use of the service that damages the subscriber or any other party.

All pornographic content and sex-related merchandising is prohibited on all SeanHQ servers. This includes sites that may infer sexual content or links to adult content elsewhere. SeanHQ will be the sole arbiter in determining violations of this provision.

Also prohibited are sites that promote any illegal activity or present content that may be damaging to SeanHQ servers or any other server on the internet. Links to such materials are also prohibited.

Examples of unacceptable content or links:

• Pirated software
• Hacker programs or archives
• Warez sites

SeanHQ staff will be the sole arbiter as to what constitutes a violation of this provision.

Commercial Advertising:

E-mail Spamming, sale of spam software, providing access for spam, or the sending of unsolicited e-mail, from a SeanHQ server or using an e-mail address or domain that is maintained on an SeanHQ machine as reference is STRICTLY prohibited.

SeanHQ staff will be the sole arbiter as to what constitutes a violation of this provision.

IRC:

IRC or IRC bots may not be operated on our servers at this time.

Server Abuse:

Any attempt to undermine or cause harm to a server or customer of SeanHQ is strictly prohibited.

Refusal of Service:

We reserve the right to refuse, cancel or suspend service at our sole discretion.

All Sub-Networks, distributive hosting sites and dedicated servers of SeanHQ must adhere to the above policies. Failure to follow any term or condition will be grounds for immediate account deactivation.

Security:

You must promptly notify SeanHQ of any breach of security related to your Services, including but not limited to unauthorized use of your password or account.

Support Guarantee:

SeanHQ.com guarantees that clients will receive a human generated response to new legitimate support requests within 24 hours. Failure to meet this guarantee will warrant 1 day's credit on the affected server(s) to the client's account.

Network Uptime Guarantee:

The SeanHQ.com upstream providers guarantee that our network will be available at least 99.9% of any full month. If that goal is not met, SeanHQ.com will pass 100% of the credit from the upstream providers to its clients in a pro-rated fashion.

Termination:

This contract may be terminated by either party, without cause, by giving the other party 14 days written notice. SeanHQ.com will accept termination by electronic mail.

Notwithstanding the above, SeanHQ.com may terminate service under this contract at any time, without penalty, if the Customer fails to comply with the terms of this contract, including non-payment. SeanHQ.com reserves the right to charge a reinstatement fee.

Any abuse of our staff in any medium or format will result in the suspension or termination of your services.

Cancellations and Refunds:

SeanHQ.com reserves the right to cancel your account and terminate service at any time with or without notice.

Refunds for web hosting account renewals will be granted to customers requesting a cancellation of their service no later than 10 days after the renewal date. No exceptions will be made to this policy. Violations of the Terms of Service will waive the refund policy.

Refunds will be processed and mailed within 5 business days of the cancellation date and will be made using the same method of payment as the original (refund by check or refund via PayPal and/ or credit card).

Please be advised that the cancellation of an account does not release you from financial responsibility. If your account has a past due balance and you are not eligible for a refund, the SeanHQ.com Accounting department will continue collection efforts.

Web, Graphics, Logo Design and Application Development Deposits:

A 50% Deposit is required for all work performed by SeanHQ.com which includes but not limited to: web design, logo creation and application development. The remaining balance is due upon the project going live or delivered. All deposits are non refundable.

Terms of Service Disclaimer:

SeanHQ.com reserves the right to modify our terms of use agreement at any time, effective upon posting of the modified agreement on this page.

Clients are responsible to read this document from time to time to ensure that their use of the service remains in compliance with this agreement.

Continued use of SeanHQ services and online facilities following any such changes shall constitute the User's acceptance of such changes.
